Neil J. Zoltowski, Senior Director at Delta, has over 25 years of experience providing litigation support and expert testimony in complex financial and economic disputes. He has advised on more than 250 matters for clients ranging from individuals to Fortune 50 companies, with a focus on quantifying economic damages in intellectual property and commercial litigation.
Neil has been designated as an expert in federal and state courts, as well as in JAMS and AAA arbitrations, testifying for both plaintiffs and defendants in cases involving IP disputes, trade secret misappropriation, licensing, breach of contract, fiduciary duty, unfair competition, false advertising, shareholder value and business valuation. Beyond testifying, Neil advises on IP licensing strategies, royalty structures, compliance, and intangible asset valuation. His experience spans many industries, including computer hardware/software, mobile devices, pay television, media and more. - Engaged by the plaintiff in an aircraft x-ray technology trade secret and contract case, calculated damages after defendant secretly partnered with a third party to commercialize technology. Testified in state court.
- On behalf of the plaintiff in a trade secret case involving food composition analyzers, calculated damages after defendants used company data to compete while still employed by plaintiff. Testified in federal court.
- Engaged by defendant to quantify damages in a trademark/copyright case over unauthorized use of a rock band’s logo in a fashion collection.

- Engaged by the defendant in a copyright case, calculated damages from allegations of unauthorized news story collection and publication. Testified in deposition.
- Advised a digital security/media leader on advancing its licensing program for a 4,000-asset patent portfolio in streaming and Pay-TV.
- For a co-defendant in a glucose monitoring contract case, rebutted opposing expert and provided alternative damages calculation. Testified in arbitration.
- For the plaintiff in a contract case, opined on unpaid fees for engineering services to a Chinese EV startup. Testified in arbitration.
