Associate Director
Benjamin Gutierrez is an Associate Director in Delta’s construction services practice, bringing deep experience in project controls, forensic planning, and schedule and delay analysis across major infrastructure and commercial projects worldwide. A civil engineer and certified Project Management Professional, Benjamin has supported expert witnesses in complex international arbitration and UK adjudication matters involving large-scale rail, energy and commercial developments. His work spans critical path analysis, programme and records evaluation, and the application of established delay methodologies under FIDIC, JCT, and NEC contracts. Benjamin’s background also includes significant on-site project delivery experience in Peru, where he oversaw project controls for government-led infrastructure programmes involving roadways, pipelines, water treatment facilities, and sports venues.
Benjamin’s technical expertise is complemented by his strong analytical, communication, and advisory skills. He has conducted detailed forensic delay assessments, prepared expert report inputs, developed programme quality analyses using tools such as Primavera P6 and Deltek Acumen Fuse, and supported experts through joint statement processes and cross-examination preparation. An accomplished researcher and presenter, Benjamin has published and delivered conference work on NEC contracts and challenges in public infrastructure projects.
- Offshore Windfarm Arbitration (Asia). Supported the programming and delay expert in an offshore windfarm arbitration by preparing chronologies, analysing critical path using P6 and contemporaneous records, developing hourly delay calculations, and drafting report sections on delay causation. Also prepared and delivered materials for client meetings.
- Rail Infrastructure ICC Arbitration (Middle East). Assisted the delay expert on a major rail dispute involving stations, switchboxes, and 32 km of track. Developed chronologies, reviewed engineering records, performed delay calculations, drafted report and joint statement inputs, critiqued the opposing expert, and prepared cross-examination materials under a FIDIC contract.
- Energy Infrastructure Advisory (Europe). Supported advisory programming and project management work on a large energy project by conducting detailed quality checks, analysing programme statistics, and evaluating schedule quality using DCMA and Acumen Fuse. Created dashboards and visualisations to enhance clarity and support expert report findings.
- Commercial Development Adjudication (UK). Assisted the expert in a UK adjudication for a large multi-plot commercial development by preparing chronologies, analysing P6 critical path updates, assessing competing delay narratives, and drafting report sections, including delay calculations and methodology for evaluating competing critical paths.
- Infrastructure Programme Controls (Peruvian Government). Led project controls for government infrastructure projects involving roads, water plants, pipelines, and stadiums. Identified risks, reviewed schedules, coordinated site inspections, and produced compliance reports. Directed small teams, evaluated progress against contractual and technical requirements, and supported decision-making through clear, actionable reporting.
