Delta’s forensic engineers and accountants provided expert witness services related to defects and lost profits claim regarding an international telecommunications satellite project.  The client, a global leader in aerospace, defense and related services, entered into a contract, to procure a type of valve for a series of satellites, from a large aerospace vendor.  Delta’s client was seeking a breach of contract claim for the defective and nonconforming goods they received.
Delta’s team investigated the project documents, visited the manufacturing and accounting facilities, interviewed the various project personnel associated with the effort, and reviewed the procurement and accounting procedures.  They independently evaluated the actual costs incurred including labor, equipment, and materials.  Our accounting experts calculated the lost profits and our client’s financing cost on the resulting working capital deficit.  Delta also assessed the forecasted cost for work yet to be performed.  Finally, we prepared our expert report and appended supporting documentation.
The case went before a three-person ICC Arbitration panel in London.  Our client was awarded virtually all damages (over $40 million USD).
